These Terms & Conditions (“Terms”) govern your purchase and use of Products and Services provided by Biox Medical Limited (“Company”, “we”, “us”, “our”).
By placing an Order or using our Products or Services, you confirm that you have read, understood, and agree to be legally bound by these Terms.

2. IMPORTANT MEDICAL DISCLAIMER
2.1 Our Products and Services provide laboratory screening only.
2.2 They:

  • Do not constitute medical advice

  • Do not provide diagnosis or treatment

  • Do not establish a doctor–patient relationship

  • Are not emergency services

2.3 Test results reflect analysis of a single submitted sample only and may not represent ongoing health status.
2.4 You must consult a qualified healthcare professional for medical advice or confirmation of results.
2.5 If you have urgent symptoms, call 999 or 111.
3. ELIGIBILITY
You confirm that:

  • You are at least 18 years old;

  • You are resident in the United Kingdom;

  • You are accessing the Site from a UK IP address;

  • You are purchasing for personal use only;

  • All information provided is accurate and complete.

Orders placed outside the UK may be cancelled.
4. ORDERS AND CONTRACT FORMATION
4.1 All Products are subject to availability.
4.2 A legally binding contract is formed only when:

  • Payment has been successfully processed; and

  • An Order Confirmation has been issued.

4.3 We reserve the right to refuse or cancel any Order prior to dispatch.
5. PRICING AND PAYMENT
5.1 Online purchases include:

  • Sampling kit

  • Laboratory testing

  • Secure delivery of Test Information

5.2 Pharmacy purchases cover the kit only. Laboratory testing and reporting are provided separately by us.
5.3 Payment must be made in full before dispatch.
5.4 If payment fails, Services may be suspended or cancelled.
6. DELIVERY AND RISK
6.1 Delivery dates are estimates only.
6.2 Risk passes to you upon delivery to your address.
6.3 Title passes once full payment is received.
6.4 We are not liable for courier delays outside our reasonable control.
6A. PRODUCT VALIDITY, NON-USE AND REACTIVATION
6A.1 Each Product must be activated, used, and the Sample received by the Accredited Laboratory within three (3) months from the date of purchase.
6A.2 If the Sample is not received within three (3) months:

  • The laboratory processing allocation shall expire;

  • Reserved laboratory capacity shall be released;

  • The testing component of the Order shall be suspended.

6A.3 We are not obliged to process any Sample received after expiry. Such Samples may be rejected or destroyed due to stability, quality assurance, and regulatory requirements.
Paid Reactivation
6A.4 You may request reactivation of an expired Product, subject to:

  • Payment of a reactivation fee;

  • Replacement of the kit (if required);

  • Reallocation of laboratory capacity;

  • Current regulatory requirements.

6A.5 Reactivation is at our sole discretion and may be refused where:

  • The kit is no longer clinically valid;

  • Regulatory standards have changed;

  • The Product has been discontinued;

  • Excessive time has elapsed.

6A.6 Where approved, a new validity period will begin from the date of reactivation confirmation.
6A.7 Expiry does not entitle you to an automatic refund.
7. CANCELLATION RIGHTS
7.1 You may cancel within 14 days of receiving the Product.
7.2 The Product must be unused and sealed.
7.3 Once the seal is broken, cancellation rights do not apply for hygiene and health protection reasons.
7.4 Return costs are your responsibility.
7.5 Refunds are processed within 14 days of receiving returned goods.
8. SAMPLE COLLECTION AND USER RESPONSIBILITY
You are responsible for:

  • Correct collection

  • Accurate registration

  • Proper packaging

  • Timely return

  • Truthful health disclosures

We are not responsible for:

  • Insufficient samples

  • Improper handling

  • Transit delays

  • Biological degradation

  • User error

Failure to comply may invalidate results without refund.
9. TEST INFORMATION
9.1 Testing is conducted by an accredited third-party laboratory.
9.2 No diagnostic test is 100% accurate. False positives and false negatives may occur.
9.3 Abnormal or reactive results must be confirmed by a qualified doctor.
9.4 We are not liable for:

  • Delay in seeking medical care

  • Personal interpretation of results

  • Emotional distress

  • Employment or insurance consequences

  • Third-party reliance

10. LIMITATION OF LIABILITY
10.1 Nothing excludes liability for:

  • Death or personal injury caused by negligence;

  • Fraud;

  • Any liability that cannot legally be excluded.

10.2 Subject to clause 10.1:

  • Our total liability shall not exceed the amount paid by you.

  • We are not liable for indirect or consequential loss.

  • We are not liable for loss of income, opportunity, reputation, or emotional distress.

11. INDEMNITY
You agree to indemnify and hold harmless the Company, its directors, employees, laboratories, and contractors from claims arising from:

  • Breach of these Terms;

  • Misuse of Products;

  • False information provided;

  • Unlawful use of results;

  • Third-party reliance.

12. DATA PROTECTION
We act as Data Controller under UK GDPR and process personal and special category health data in accordance with our Privacy Policy.
By submitting a Sample, you provide explicit consent to processing of your health data.
13. FORCE MAJEURE
We are not liable for delays or failure caused by events beyond reasonable control, including pandemic, government action, supply chain disruption, or cybersecurity incidents.
14. INTELLECTUAL PROPERTY
All website content remains our property. Unauthorised use is prohibited.
15. GOVERNING LAW
These Terms are governed by the laws of England and Wales.
Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
16. SEVERABILITY
If any provision is found unenforceable, the remainder remains valid.
